Terms and Conditions

By agreeing to work with us, the client agrees to the following terms & conditions.

Communication: Positively Princess LLC primarily communicates via email to ensure clarity, consistency, and documentation of all conversations. This allows multiple employees to stay informed and prevents discrepancies. Most emails receive a response within 24-48 hours, excluding weekends.

Deposit: A 50% deposit is required at the time of booking to secure your party or event date. The deposit is non-refundable, however it will be transferred to a one time rescheduled event. Payments will be made through Square via an invoice. Transaction fees may apply. A check is allowed for corporate companies upon request and must be provided in advance.

Balance: The total invoice balance must be paid, at MINIMUM, 7 days before your event. If your total amount is not paid at least 7 days before your event you will incur a $10 late fee per day. If full payment is not received by 24 hours prior to the event and an agreement has not been made, Positively Princess LLC has the right to cancel the event, and all deposits made prior will not be refunded.

Cancellations/ Reschedules: When a client books and pays a deposit, the company reserves the performer/time for them. Canceling impacts both the performer’s pay and the company’s ability to book other clients.

Cancelations are allowed at any time, but specific rescheduling and fee policies apply:

  • Rescheduling at least 7 days in advance: One free reschedule is permitted.

  • Rescheduling less than 7 days in advance: A $25 rescheduling fee applies.

  • Canceling less than 24 hours before the event: All payments are forfeited, and a new booking is required for service.

Changes must be emailed for documentation. Rescheduling fees apply to all events. Clients should prepare an inclement weather plan.

Travel Fees: Positively Princess LLC is based in Appleton, Wisconsin. For bookings beyond a 35-mile radius, a travel fee of $0.75 per mile will apply. This fee covers round-trip travel expenses and is paid directly to the performer.

Activities: Positively Princess LLC ensures performers have plenty of planned activities to keep children engaged. Unless requested otherwise, performers will follow the activities outlined in the chosen party package but may adjust them as needed. Clients who prefer strict adherence to the planned activities must ensure children are actively listening and participating. Performers are trained to "read the room" and adjust activity order accordingly. While they aim to complete all activities, unforeseen circumstances may prevent this. In such cases, performers may stay up to 5 minutes past the scheduled end time at no extra cost..

Location: Proper accommodations will be provided by the client. If rain/snow occurs and the event has been scheduled outdoors, it is the responsibility of the client to arrange for an indoor event. For temperatures below 60F degrees or above 85F degrees, the party must take place in an indoor venue. Activities may be affected depending on the conditions. Please have an inclement weather plan for your event.

Performer Preference: We do our best to cast every performer as accurately as possible. We will never send you a performer that does not resemble your character or share ethnic features with your character. A client’s performer request is based on the availability of performers and is NEVER guaranteed or promised.

Photo Release: On occasion, our assistants may take photos at your party as a training or marketing tool. Any photos you publicly post to any of our social media pages and any photos taken are hereby signed as released to be used by Positively Princess for our website, social media, and promotional use. If you do not want any pictures of your party taken, please let us know in advance.

Allergies: The client must inform Positively Princess LLC of any allergies to food or products such as nail polish, latex, acrylics, temporary tattoos, or face paints prior to the event or party. The client understands that Positively Princess is NOT responsible for any injuries or allergic reactions that occur at your event.

Smoking and Alcohol: Positively Princess LLC prohibits smoking near costumes, property, and performers to prevent damage. Clients must ensure guests refrain from smoking. While alcohol is allowed, excessive drinking should be avoided. If a performer feels uncomfortable due to smoking or excessive drinking, they may end their visit early without a refund.

Pets: All pets, apart from service animals, must be contained away from the party area.

Liability: The client agrees to hold Positively Princess LLC and its performers harmless from any property damage or bodily injury caused by the client or guests.

Safety: Our performers are trained to always keep the safety of your guests in mind. If there is ever a situation where the performer(s) or manager(s) feel unsafe, they may address the issue with the parent/guardian/client. If the issue is not resolved, the performer will leave. We hold the right to leave at any time due to safety concerns.

Breach: Any breach in this contract by the client automatically constitutes a cancellation of your party/event and any and all payments made to Positively Princess LLC will be forfeited

Tardiness: Positively Princess LLC gives performers an extra 30 minutes more driving time than they should need for every event. Clients will receive ETA updates, and performers will always stay for the full booked time. To amend tardiness:

  • Up to 30 minutes late: A special card/note from the character and a coupon will be sent.

  • 30-60 minutes late: A 10% refund, plus a character card/note and a coupon.

  • Over 60 minutes late: Clients may cancel for a full refund and receive a free 30-minute visit later, or continue with a 50% refund.

Character Call Out: In the very rare event that the scheduled character cannot attend, Positively Princess LLC offers the following options:

·         Choose an available replacement character, with the originally scheduled character sending a video message.

·         Cancel for a full refund and receive a free 30-minute party at a later date.

·         If an “additional character” is the one who cannot make it, we will give you the option to choose someone else in their place OR we will refund you in full for the additional character and send you a video from that character wishing your child a happy birthday as early as possible.
